“Marcellus Williams is scheduled to be executed on Sept. 24, for a crime he did not commit. DNA evidence proves Marcellus Williams is innocent.”


Marcellus Williams is scheduled to be executed on Sept. 24 for a crime DNA proves he did not commit. The St. Louis County prosecuting attorney reviewed these DNA results and filed a motion to vacate Mr. Williams’ conviction because he believed the DNA results proved by clear and convincing evidence that Mr. Williams did not commit this crime. Although the circuit court has not yet scheduled a hearing to address this motion — and no court has ever considered the new exculpatory evidence — the Missouri Supreme Court set an execution date for Mr. Williams.”


Case update: The Circuit Court of St. Louis County, Missouri, scheduled a hearing for August 21, 2024, to assess the “clear and convincing evidence” of actual innocence that led Prosecuting Attorney Wesley Bell to move to vacate Marcellus Williams’ wrongful conviction and death sentence. On July 27, the Missouri Supreme Court denied MO Attorney General Andrew Bailey’s “request to block an August hearing to determine if Marcellus Williams, set to be executed in September, is innocent of murder.” “The ruling comes about a week after the attorney general’s office filed the motion to block the hearing. His lawyers argued that the St. Louis County Circuit Court judge does not have the authority to reverse or overrule Marcellus Williams’ first-degree murder conviction because a higher court has already issued a ruling in the case and set an execution date.”  KOMU / St. Louis Post Dispatch July 27 https://www.komu.com/news/state/missouri-high-court-denies-ags-request-to-block-innocence-hearing-for-marcellus-williams/article_2618aef8-a292-5b73-a315-d2ee3c620007.html
